When evidence-based policymaking is so often mired in disagreement and controversy, how can we know if the process is meeting its stated goals? We develop a novel mathematical model to study disagreements about adequate knowledge utilization, like those regarding wild horse culling, shark drumlines and facemask policies during pandemics. We find that, when stakeholders disagree, it is frequently impossible to tell whether any party is at fault. We demonstrate the need for a distinctive kind of transparency in evidence-based policymaking, which (...) we call transparency of reasoning. Such transparency is critical to the success of the evidence-based policy movement, as without it, we will be unable to tell whether in any instance a policy was in fact based on evidence. (shrink)

Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health and (...) Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. As Christian List (2021) has recently argued, the increasing arrival of powerful AI systems that operate autonomously in high-stakes contexts creates a need for “future-proofing” our regulatory frameworks, i.e., for reassessing them in the face of these developments. One core part of our regulatory frameworks that dominates our everyday moral interactions is blame. Therefore, “future-proofing” our extant regulatory frameworks in the face of the increasing arrival of powerful AI systems requires, among others things, that we ask whether it makes sense (...) to extend our blaming practices to these systems. In the paper, we argue for the admittedly surprising thesis that this question should be answered in the affirmative: contrary to what one might initially think, it can make a lot of sense to blame AI systems, since, as we furthermore argue, many of the important functions that are fulfilled by blaming humans can also be served by blaming AI systems. The paper concludes that this result gives us a good pro tanto reason to extend our blame practices to AI systems. (shrink)

Wicked problems are tricky to solve because of their many interconnected components and a lack of any single optimal solution. At the science–policy interface, all problems can look wicked: research exposes the complexity that is relevant to designing, executing and implementing policy fit for ambitious human needs. Expertise in philosophical research can help to navigate that complexity.

In this paper we suggest a revisionist perspective on two significant figures in early modern life science and philosophy: William Harvey and John Locke. Harvey, the discoverer of the circulation of the blood, is often named as one of the rare representatives of the ‘life sciences’ who was a major figure in the Scientific Revolution. While this status itself is problematic, we would like to call attention to a different kind of problem: Harvey dislikes abstraction and controlled experiments (aside from (...) the ligature experiment in De Motu Cordis), tends to dismiss the value of instruments such as the microscope, and emphasizes instead the privileged status of ‘observed experience’. To use a contemporary term, Harvey appears to rely on, and chiefly value, ‘tacit knowledge’. Secondly, Locke’s project is often explained with reference to the image he uses in the Epistle to the Reader of his Essay, that he was an “underlabourer” of the sciences. In fact, despite the significant medical phase of his career, Locke’s ‘empiricism’ turns out to be above all a practical (i.e. ‘moral’) project, which focuses on the delimitation of our powers in order to achieve happiness, and rejects the possibility of naturalizing knowledge. When combined, these two cases suggest a different view of some canonical moments in early modern natural philosophy. (shrink)

A presente pesquisa visa caracterizar o método empregado por Aristóteles na Ethica Nicomachea a partir de uma análise que contrasta duas interpretações: de um lado, a tese já tradicional que busca ver na filosofia prática do Estagirita um método estritamente dialético; de outro, a tese alternativa, explorada apenas recentemente, que aponta o uso, na EN, de um procedimento filosófico próximo das prescrições sugeridas nos Segundos Analíticos para a busca definicional nas ciências. O núcleo da primeira tese deverá ser analisado sob (...) duas perspectivas: (i) examinando um conjunto de textos que revelam o teor dialético da filosofia aristotélica; e (ii) avaliando o processo de expansão da noção de dialética e suas implicações para os estudos aristotélicos. Alternativamente, (i) será examinado como um modelo de tipo definicional pode reaproximar a ética do registro científico dos Segundos Analíticos sem necessariamente se valer de argumentos dialéticos. Por fim (ii), proponho uma versão deflacionária do que deve contar como método dialético em Aristóteles. (shrink)

Newton’s impact on Enlightenment natural philosophy has been studied at great length, in its experimental, methodological and ideological ramifications. One aspect that has received fairly little attention is the role Newtonian “analogies” played in the formulation of new conceptual schemes in physiology, medicine, and life science as a whole. So-called ‘medical Newtonians’ like Pitcairne and Keill have been studied; but they were engaged in a more literal project of directly transposing, or seeking to transpose, Newtonian laws into quantitative models of (...) the body. I am interested here in something different: neither the metaphysical reading of Newton, nor direct empirical transpositions, but rather, a more heuristic, empiricist construction of Newtonian analogies. Figures such as Haller, Barthez, and Blumenbach constructed analogies between the method of celestial mechanics and the method of physiology. In celestial mechanics, they held, an unknown entity such as gravity is posited and used to mathematically link sets of determinate physical phenomena (e.g., the phases of the moon and tides). This process allows one to remain agnostic about the ontological status of the unknown entity, as long as the two linked sets of phenomena are represented adequately. Haller et. al. held that the Newtonian physician and physiologist can similarly posit an unknown called ‘life’ and use it to link various other phenomena, from digestion to sensation and the functioning of the glands. These phenomena consequently appear as interconnected, goal-oriented processes which do not exist either in an inanimate mechanism or in a corpse. In keeping with the empiricist roots of the analogy, however, no ontological claims are made about the nature of this vital principle, and no attempts are made to directly causally connect such a principle and observable phenomena. The role of the “Newtonian analogy” thus brings together diverse schools of thought, and cuts across a surprising variety of programs, models and practices in natural philosophy. (shrink)

Locke and Leibniz deny that there are any such beings as ‘monsters’ (anomalies, natural curiosities, wonders, and marvels), for two very different reasons. For Locke, monsters are not ‘natural kinds’: the word ‘monster’ does not individuate any specific class of beings ‘out there’ in the natural world. Monsters depend on our subjective viewpoint. For Leibniz, there are no monsters because we are all parts of the Great Chain of Being. Everything that happens, happens for a reason, including a monstrous birth. (...) But what about materialism? Well, beginning with the anatomical interest into ‘monstrous births’ in the French Académie des Sciences in the first three decades of the eighteenth century, there is a shift away from ‘imaginationist’ claims such as those of Malebranche, that if a woman gives birth to a monstrous child it is a consequence of something she imagined. Anatomists such as Lemery and Winslow try to formulate a strictly mechanical explanation for such events, rejecting moral and metaphysical explanations. Picking up on this work, materialist thinkers like Diderot are compelled to reject the very idea of monsters. We are all material beings produced according to the same mechanisms or laws, some of us are more ‘successful’ products than others, i.e. some live longer than others. In his late Eléments de physiologie he says “L’homme est un effet commun, le monstre un effet rare.” Ultimately he arrives at a materialist version of Leibniz’s position: there are no monsters, we are all monsters in each other’s eyes, at one time or another. This conclusion is a pregnant one in light of twentieth century interest in the problem of ‘the normal and the pathological’ (Canguilhem), and the broader question of how materialism relates to the biological world. In his Philosophical Inquiry concerning Human Liberty (1717), the English deist Anthony Collins proposed a complete determinist account of the human mind and action, partly inspired by his mentor Locke, but also by elements from Bayle, Leibniz and other Continental sources. It is a determinism which does not neglect the question of the specific status of the mind but rather seeks to provide a causal account of mental activity and volition in particular; it is a ‘volitional determinism’. Some decades later, (...) Diderot articulates a very similar determinism, which seeks to recognize the existence of “causes proper to man” (as he says in the Réfutation d’Helvétius). The difference with Collins is that now biological factors are being taken into account. Obviously both the ‘volitional’ and the ‘biological’ forms of determinism are noteworthy inasmuch as they change our picture of the nature of determinism itself, but my interest here is to compare these two determinist arguments, both of which are broadly Spinozist in nature – and as such belong to what Jonathan Israel called in his recent book “the radical Enlightenment,” i.e. a kind of underground Enlightenment constituted by Spinozism – and to see how Collins’ specifically psychological vision and Diderot’s specifically biological vision correspond to their two separate national contexts: determinism in France in the mid-1750s was a much more medico-biological affair than English determinism, which appears to be on a ‘path’ leading to Mill and associationist psychology. The concept of self has preeminently been asserted (in its many versions) as a core component of anti-reductionist, antinaturalistic philosophical positions, from Descartes to Husserl and beyond, with the exception of some hybrid or intermediate positions which declare rather glibly that, since we are biological entities which fully belong to the natural world, and we are conscious of ourselves as 'selves', therefore the self belongs to the natural world (this is characteristic e.g. of embodied phenomenology and enactivism). Nevertheless, from Cudworth (...) and More’s attacks on materialism all the way through twentieth-century argument against naturalism, the gulf between selfhood and the world of Nature appears unbridgeable. In contrast, my goal in this paper is to show that early modern materialism could yield a theory of the self according to which (1) the self belongs to the world of external relations (Spinoza), such that no one fact, including supposedly private facts, is only accessible to a single person; (2) the self can be reconstructed as a sense of “organic unity” which could be a condition for biological individuality (a central text here is Diderot’s 1769 Rêve de D’Alembert); yet this should not lead us to espouse a Romantic concept of organism as foundational or even ineffable subjectivity (a dimension present in Leibniz and made explicit in German idealism); (3) what we call 'self' might simply be a dynamic process of interpretive activity undertaken by the brain. This materialist theory of the self should not neglect the nature of experience, but it should also not have to take at face value the recurring invocations of a better, deeper “first-person perspective” or “first-person science.”. How does Locke contribute to the development of 18th-century projects for a science of the mind, even though he seems to reject or at least bracket off such an idea himself? Contrary to later understandings of empiricism, Locke goes out of his way to state that his project to investigate and articulate the ‘logic of ideas’ is not a scientific project: “I shall not at present meddle with the Physical consideration of the Mind” (Essay, I.i.2). Locke further specifies that this (...) means his analysis of mental processes will not engage with knowledge of the brain (e.g. in terms of corpuscles and animal spirits), even though he had been the student of Thomas Willis. Now, Kant seemed to make an elementary mistake, given such a clear statement on Locke’s part, when he claimed that Locke’s project was a “physiology of the understanding” (in the Preface to the A edition of the first Critique). One can ask of course what this physiology of the understanding was, and if it existed, in or out of the Lockean intellectual world (as I have sought to investigate in a 2016 paper). This leads me to inquire into the outcome of his empiricism for a scientific treatment of the mind, including in the sense of a ‘naturalization’ of the mind (with implications also for our understanding of empiricism: Anstey’s influential distinction between experimental and speculative philosophy does not seem useful here). Because if Kant made this charge, there were also many 18th-century thinkers who positively treated Locke as their great forerunner in psychology and related fields: Charles Bonnet and Joseph Priestley among them, just as some prominent physicians such as Cabanis claimed to be ‘finishing the job’ that Locke had started in, e.g. their materialist theories of the passions. What one might term ‘the Locke Problem’ here is: how can one reconcile empiricism and claims about cerebral processes, while seeking to remain a Lockean? Differently put, what is the process of naturalization, a naturalization of? (shrink)

Sind die Menschenrechte primär Ausdruck einer politischen Praxis und die Idee der Menschenrechte eine Art „Überbau“, den die Praxis epiphänomenal hervorbringt? Oder ist die Praxis der Menschenrechte das Ergebnis der Verwirklichung einer normativen Idee, die unabhängig von ihr existiert? Ist die Idee der Menschenrechte die Bedingung dafür, dass es die Praxis der Menschenrechte geben kann? Oder gibt es einen Vorrang der Praxis vor der Idee? In meinem Aufsatz argumentiere ich für zwei These: 1. These: Menschenrechte sind prinzipiell unabhängig von jeder (...) bestehenden rechtlichpolitischen Praxis und sind zugleich untrennbar an bestimmte rechtlich-politische Praktiken geknüpft. Darin besteht der konstitutive Widerspruch der Menschenrechte. 2. These: Aus diesem Widerspruch folgt nicht, dass wir aufhören sollten über Menschenrechte nachzudenken und eine Politik der Menschenrechte anzustreben. Der Widerspruch hat keine lähmende Wirkung, sondern ist theoretisch und praktisch produktiv. Um diese Thesen zu plausiblisieren, werde ich zunächst einige Grundzüge von Arendts Diskussion der Menschenrechte rekapitulieren (Abschnitt 2) und ihr Postulat eines den Menschenrechten vorgelagerten „Rechts, Rechte zu haben“ diskutieren (Abschnitt 3). Ausgehend von einer kritischen Diskussion der diskurstheoretischen Weiterentwicklung von Arendts These zu einem „Recht auf Rechtfertigung“ im diskurstheoretischen Konstruktivismus von Seyla Benhabib und Rainer Forst (Abschnitt 4) werde ich einen rechtfertigungstheoretischen Dekonstruktivismus vorstellen, der das Verhältnis von Praxis und Idee der Menschenrechte als produktiven Widerspruch fasst (Abschnitt 5). The brain in its plasticity and inherent 'sociality' can be proclaimed and projected as a revolutionary organ. Far from the old reactions which opposed the authenticity of political theory and praxis to the dangerous naturalism of 'cognitive science' (with images of men in white coats, the RAND Corporation or military LSD experiments), recent decades have shown us some of the potentiality of the social brain (Vygotsky, and more recently Negri 1995 and Negri 2000, Virno 2001). Is the brain somehow inherently (...) a utopian topos? If in some earlier papers I sought to defend naturalism against these reactions, here I consider a new challenge: the recently emerged disciplines of neuronormativity, which seek in their own way to overcome the nature-normativity divide. This is the task of a materialist brain theory today. 1. The setup: horns of a dilemma There is a lingering zone of what one might think of as sore cognitive muscle tissue in the area of materialism. It is an area of both contested territory and in some cases, a kind of pathos of distance of the 'Ugh! Keep that thing away from me!' sort. I have in mind the combination of materialism as an emancipatory socio-political project (which need not be construed in strictly Marx-Engels terms, if we think of Lucretius et al.) and as a cold-hearted 'spontaneous philosophy of the men in white coats', e.g. nefarious neurophilosophers. Faced with this rather massive alternative, this choice between two projects, I have stubbornly been saying since some discussions with Negri in the late 90s. (shrink)

The Netherlands was the first country to legalize euthanasia and physician-assisted suicide. This paper offers a first legal perspective on the prospects of using AI in the Dutch practice of euthanasia and physician-assisted suicide. It responds to the Regional Euthanasia Review Committees’ interest in exploring technological solutions to improve current procedures. The specific characteristics of AI – the capability to process enormous amounts of data in a short amount of time and generate new insights in individual cases – may for (...) example alleviate the increased workload of review committees due to the continuous increase of euthanasia cases. The paper considers three broad categories for the use of AI in the Dutch euthanasia practice: (1) the physician’s assessment of euthanasia requests, (2) the actual execution of euthanasia, and (3) the retrospective reviews of cases by the Regional Euthanasia Review Committees. Exploring the legal considerations around each avenue, both in the EU AI Act and the Dutch legal framework, this paper aims to facilitate the societal discussion on the role of technology in such deeply human decisions. This debate is equally relevant to other countries that legalized euthanasia (e.g. Belgium and Canada) or physician-assisted suicide (e.g. Switzerland and numerous states in the US). (shrink)

Investigando-se sobre o que constitui cada experiência em particular, a da violência (ainda que sob a forma da guerra ou da revolução) e a da política, esta relação permitirá equacionar criticamente as possibilidades e os limites das sociedades democráticas actuais como o resultado da tradição política e das revoluções da (...) modernidade. O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A (...) conclusão é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)

Collected essays consider points of affinity and friction between Walter Benjamin and Martin Heidegger. Despite being contemporaries, Walter Benjamin and Martin Heidegger never directly engaged with one another. Yet, Hannah Arendt, who knew both men, pointed out common ground between the two. Both were concerned with the destruction of metaphysics, the development of a new way of reading and understanding literature and art, and the formulation of radical theories about time and history. On the other hand, their life trajectories (...) and political commitments were radically different. In a 1930 letter, Benjamin told a friend that he had been reading Heidegger and that if the two were to engage with one another, “sparks will fly.” Acknowledging both their affinities and points of conflict, this volume stages that confrontation, focusing in particular on temporality, Romanticism, and politics in their work. No presente trabalho, com vistas para uma análise conceitual e crítica acerca do modelo de democracia representativa, bem como uma proposta de mudança sistemática e ordenada, iremos nos debruçar sobre os conceitos e perspectivas elencadas por Arendt e Bobbio no cerne da questão participativa. Hannah Arendt (1941-1975), ilustre teórica política, compreende a sociedade consolidada pós revoluções americana e francesa como fortemente apolitizada, visto o afastamento dos cidadãos dos assuntos públicos na atual democracia indireta. Norberto Bobbio (1909-2004), renomado jusfilósofo, define (...) com rigor analítico a categoria representativa da participação popular nas questões coletivas, indicando suas limitações e possibilidades. Em vista disso, faz-se necessário o estudo conjunto de ambas personalidades para o entendimento da disposição comum no que diz respeito à representatividade política que, segundo a autora alemã, impede a efetiva realização da vida cívica e atomiza os sujeitos, suscitando o desinteresse pela coisa pública e facilitando a oligarquização da mesma. A partir da inferência no que se refere ao foco central deste artigo, e da investigação complementar sobre os próprios riscos da implementação excessiva dos cânones reverberados pela tradição antiga — a qual pressupõe o envolvimento direto dos cidadãos no governo —, perpassaremos pela alternativa proposta por Arendt, a saber: a criação de conselhos deliberativos nos diversos níveis subnacionais a fim de fomentar o maior interesse e atuação popular na tomada de decisões, salvaguardando, assim, parte significativa do espírito revolucionário mas, sem retirar a centralidade de um governo bem estabelecido. Dessa maneira, a relação entre Arendt e Bobbio se designará no exame do sistema democrático representativo com respeito às limitações impostas pelo próprio sistema que impede a plena participação popular qualitativa, juntamente com a orientação arendtiana para rarear essa problemática — embora sem buscar a completa aniquilação do mecanismo de partidos, mas a união deste com o modelo de conselhos. Hannah Arendt’s politics is aesthetic rather than practical, motivated by enjoyment rather than well-being, and so it should be rejected. I begin with an account of aestheticism as the doctrine according to which seemingly non-aesthetic things are actually aesthetic, parts of a whole dimension of reality that we might simply call “the aesthetic.” We access it by taking a disinterested attitude, one that affirms things for their own sakes, and there are four ways of doing this: disinterested appreciating (e.g., (...) of beautiful art), fun playing, fantasizing, and putting on shows or spectacles. While Arendt’s politics takes a classical republican form that is like a competitive game, an analysis of her conceptions of acting and judging reveals that the modes of disinterested showing and appreciating are also present. Her philosophy has another motivation, however, alongside enjoying the aesthetic: the need to escape the reality of evil. (shrink)

Lepenies si propone di individuare le cause storico-sociali e le conseguenze sociologicamente rilevanti degli atteggiamenti individuali e collettivi melanconici per la genesi, la conservazione e innovazione delle strutture sociali. Egli afferma che non intende definire a priori che cosa sia la melanconia, ma piuttosto ricostruirne il significato tramite le rappresentazioni dei vissuti interiori di coloro che si sono autodefiniti tali attingendo alla letteratura di corte, salottiera nobiliare e borghese, francese e tedesca. In realtà, egli (...) esamina le differenti rappresentazioni della malinconia, alla luce del quadro clinico elaborato dalla psicoanalisi di S. Freud e dalla psichiatria di E. Kraepelin, H. Tellenbach, ecc., e dello schema sociologico dei tipi di adattamento di R.K. Merton. Queste categorie concettuali consentono a Lepenies di ricostruire gli atteggiamenti malinconici che si diffusero presso due diversi ceti sociali in tempi e in luoghi differenti: 1) i ceti nobiliari francesi dopo la sconfitta della Fronda e 2) la borghesia tedesca del ‘700. Neste artigo, tivemos o objetivo de analisar como o racionalismo ético limita a ética. Frente a este propósito, expomos a fonte trágica da ética de Aristóteles, para quem a ética não é ciência e não tem uma fonte metafísica. A revelação de Aristóteles mostrou como o seu pensamento ético, por ultrapassar o racionalismo filosófico, inaugura uma corrente de pensamento moral cuja modéstia é mais adequada à fragilidade da condição humana.

This review-essay considers two books by David Brezis and Hannah E. Hashkes, and discusses their significance for exploring the philosophical links between Jewish thought and classical American pragmatism.

Este capítulo se propõe a analisar os fundamentos utilizados por Aristóteles (2006) para justificar a escravidão. Para isso, é tomada como chave de leitura a categorização das atividades humanas fundamentais proposta por Hannah Arendt (2008). A escravidão no mundo grego antigo era tida como uma forma de liberar o cidadão dos afazeres domésticos e do trabalho para que pudesse ter ócio e, assim, dedicar-se às atividades entre seus iguais, sobretudo à política.

Este artigo discute os textos de Hannah Arendt a partir de um problema particular: aquele relativo à procura da compreensão. Esse problema é importante não apenas porque seus textos realizam uma contribuição decisiva para a compreensão daquilo que a política se tornou a partir do século XX, mas, sobretudo, porque ele nomeia o ponto sensível de sua escrita.

A obra de Hannah Arendt tem uma forte presença hegeliana, seja em virtude de convergências temáticas, seja em virtude de divergências fundamentais do ponto de vista metodológico, ontológico e político. Salvaguardadas as diferenças de detalhe no tratamento dessas questões, as convergências temáticas fazem-se notar na distinção entre social e político e no lugar que a singularidade ocupa nas suas teorias políticas. In Brazil, the social demand for veterinary expertise is growing. However, there is still a shortage of professionals trained in this area to apply specific knowledge to each case. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. Pretende-se analisar a compreensão de Hannah Arendt e dos teóricos críticos Max Horkheimer e Theodor Adorno sobre o papel da política na ascensão do nacional-socialismo, em seus escritos das décadas de 1930 a 1950. É proposto um estudo comparativo de suas divergências quanto à importância explicativa da política e de suas motivações para a crítica à política moderna. Serão discutidos os diferentes caminhos explicativos, os sentidos atribuídos à autoridade e à ideologia e a particularidade da discussão arendtiana sobre o (...) terror totalitário. Partindo destas análises da política moderna, esta investigação tem por objetivo, em primeiro lugar, demonstrar o caráter estrutural do seu confronto, na concepção de poder inerente à teorização da política, tendo-se em vista o peso da liberdade e da dominação subjetiva e, em seguida, pensar o caráter profícuo de alguns aspectos de suas teorizações à luz da experiência contemporânea. For this analysis, we enjoy elements of the history and philosophy of work, having as supreme objective, to culminate in a generic and integral perspective sufficient for the understanding of the most varied human works existing in the history of mankind and, thus, to suggest a new look at the sociology of work, leaving aside, together with other scientific disciplines, a vague, laggard and reduced concept, as well as without potentiality for the future of work, as a formal and primarily salaried work. -/- Keywords: Concept; Work; History; Definition. -/- -/- BASES TEMÁTICAS DESSE TRABALHO -/-  O trabalho é um conceito construído socialmente; -/-  A modernidade trouxe consigo mudanças significativas quanto à valorização do trabalho; -/-  A origem dos mercados de trabalho, juntamente com o surgimento do capitalismo, minimizaram o trabalho como um mero emprego assalariado; -/-  O trabalho, no entanto, apresenta múltiplas manifestações nas nossas sociedades. -/- -/- 1. SOBRE A DEFINIÇÃO DO TRABALHO -/- Gostaríamos de começar esse texto com uma introdução à definição de trabalho, uma questão de importância indiscutível, considerando o trabalho não apenas como o objeto de estudo da Sociologia do Trabalho, mas também como um tema de discussão contemporânea que obteve inúmeros conceitos de grandes autores ao longo da história, desde o trabalho como algo “escravista” ao homem, até a supervalorização do mesmo mediante ao homem. -/- O trabalho, nas palavras de Yves Simon (1903-1961) , é um daqueles termos que são precedidos por fatos da vida cotidiana do homem, que se escondem por trás do mistério do habitual ou usual. É um termo, portanto, que possui uma riqueza factual muito superior à qualquer definição que se pode concentrar. Santo Agostinho (354-430), referindo-se ao tempo, sabia o que era, mas se o perguntassem como defini-lo, apontou que não sabia como fazê-lo (“Si nemo ex me quaerat, scio; si quaerenti explicare velim, nescio”), traduzindo (“Se ninguém me perguntar, sei o que é; mas se quiser explicá-lo a quem me perguntar, não sei”). -/- Assim como Agostinho, algo parecido acontece conosco quando nos pedem para definir o trabalho. Assim como diria Werner Sombart (1863-1941), a palavra pode não ter um significado real, apesar de seu uso frequente. E é que o trabalho, como uma atividade criativa, faz parte da história humana desde sua gênese, há mais de 2 milhões de anos atrás, quando o homo habilis mostrou-se capaz de criar conscientemente e por si próprio (e não por mera carga genética como acontece com várias espécies animais) seus próprios instrumentos. -/- O supracitado Yves Simon, escolheu em seu texto mais representativo sobre o tema, uma maneira mais razoável de se definir o trabalho. Começou com o método de caso mais óbvio. Nesse sentido, mostrou que a ambivalência entre o trabalho manual e intelectual que o tempo parece não deixá-lo ir completamente, optara pelos “trabalhadores ao invés dos advogados, comerciantes ou homens de letras”. Essa ordem de prioridade não significa exclusão, mas sim graus de aceitação que considero fazer parte do critério ainda mantido por muitos a respeito do termo “trabalho”. -/- Nesse sentido, argumenta-se que o trabalho manual corresponde a sua ligação direta com a natureza física. O termo “direto” não ignora a mediação de máquinas e ferramentas, apenas comenta seu caráter relacional com a natureza. Logo, o trabalho significa a modificação de algo. -/- Entre as características desse trabalho, ao menos o manual, Simon ressalta que é uma atividade apenas transitória. Isso significa que o trabalho produz um efeito fora do agente que o executa. É o caso de um carpinteiro que age sobre a madeira para moldá-la e transformá-la em um bem de uso posterior como uma mesa, um banco, etc. -/- O mesmo autor ressalta que, se o efeito reside apenas no agente e não em um assunto externo, estaríamos enfrentado algo que chamaríamos de jogo, esporte, exercício ou mesmo a “imitação do trabalho”. -/- Por outro lado, o trabalho é uma atividade útil, isto é, propício para produzir um bem que seja útil e desejável por alguém. Finalmente, a racionalidade é um elemento que distingue o trabalho dos homens em relação com os animais. Essa ideia remonta com Hume (1711-1776), que insistia que o trabalho distingue os homens dos animais. Essa visão também será desenvolvida com Marx (1818-1883), que reproduzimos mediante uma célebre passagem do primeiro livro de O Capital. -/- [...] Pressupomos o trabalho numa forma em que pertence exclusivamente ao homem. Uma aranha executa operações semelhantes às do tecelão, e a abelha envergonha mais de um arquiteto humano com a construção dos favos de suas colmeias. Mas o que distingue, de antemão, o pior arquiteto da melhor abelha é que ele construiu o favo em sua cabeça, antes de construí-lo em cera (MARX, 1996, p. 297/98). -/- Na tradição marxista, foi Engels (1820-1895) quem parou mais nesses questões. Em seu ensaio particular escrito em 1876 e intitulado “O papel do trabalho na transformação do macaco em homem”, sintetiza a ideia de que é o trabalho quem cria e faz o homem. -/- Passando para o trabalho intelectual, Simon ressalta que, na verdade, a medida em que contribui para o trabalho manual desenvolvido por outros, a atividade intelectual também poderá ser denominada de trabalho. Avançando nessa concepção do filósofo, posteriormente, ele aponta “para que uma atividade seja qualificada como trabalho, ela deve ser não apenas honesta mas, também, socialmente produtiva”. -/- Essa concepção de utilidade produtiva é a mais generalizada no momento de distinção do trabalho com demais atividades. Como exemplo, podemos citar Friedmann (1902-1977) que aponta que a utilidade é a primeira característica do trabalho humano. E ainda cita economistas como Colson (1853-1939). Ressalta ainda que “o trabalho é o meio pelo qual o homem exerce suas capacidades físicas e morais para a produção de riquezas ou serviços”. Por outro lado, o filósofo Bergson (1859-1941) escreveu que “o trabalho humano consiste em criar utilidade”. Não obstante, Friedmann se pergunta se a teleologia do trabalho é a única variável a ser tomada em conta para a construção da definição do conceito. Nesse sentido, ele aponta a necessidade de se incluir outros fatores relevantes para essa edificação do conceito, uma vez que os animais também “criam utilidade”. Logo, a distinção poderia estar presente no “marco de uma luta social contra a natureza”. Mediante isso, o trabalho seria “essencialmente através da técnica, a transformação que o homem faz da natureza que, por sua vez, reage ao homem modificando-a”. É a mesma visão marxista que fizemos referência anteriormente, segundo o qual o “trabalho é, em primeiro lugar, um processo entre o homem e a natureza, como o qual o homem regula, realiza e a controla por meio de suas ações, sua troca de assuntos com a natureza. Coloca em ação suas forças naturais que configuram sua corporeidade, seus braços e pernas, cabeça e mãos, para que desse modo, possa assimilar, sob uma forma útil à sua própria vida, os materiais que a natureza o proporciona. E ao mesmo tempo que age na natureza externa e a transforma, transforma também sua própria natureza, desenvolvendo, assim, as faculdades antes adormecidas em si”. Inteligentemente, Friedmann foi capaz de assegurar que, no mundo contemporâneo, tal definição é parcial, uma vez que, nem todas as atividades do homem são rurais e manufatureiras, onde a relação-transformação com a natureza é mais evidente. As atividades denominadas terciárias, segundo a tradicional tipologia de Colin Clark (1905-1989), e que ampliarei posteriormente no conceito de trabalho intelectual, também devem ser levadas em consideração. Nesse sentido, Friedmann ressalta que, no século XX, o homem no trabalho não é sempre e menos ainda, no sentido clássico do termo, um homo faber. -/- Todavia, isso força Friedmann a pensar em um conceito diferente de trabalho e, para isso, ele confia que “determinada imposição” é específica e o diferencia de outras atividades que não são trabalho. Dessa maneira, para um trabalho ser tal deverá ter uma quota indispensável de obrigações. -/- Tantas indagações e reflexões acerca do supracitado, nos obriga a perguntamo-nos: a pessoa “trabalha” apenas se for obrigada a fazê-lo? Os animais não trabalham/produzem? Em condições de alienação desenvolvida e, portanto, o homem desconhecendo o fim último do seu labor, não estamos lidando com um trabalho? Quem age sobre a natureza, afim de destruí-la logo, não lhe conferindo valor, está trabalhando? A dona de casa que não produz para o mercado de trabalho não está trabalhando? Todas essas perguntas, se respondidas, fariam menção a um conceito de trabalho que, sem dúvida, ainda não foi unanimemente construído pela humanidade. De fato, quando vemos culturas e povos distintos, notamos que eles lidaram com conceitos muito diferentes sobre o que é e o que não é trabalho. Mesmo dentro dessas culturas – incluindo a nossa- e aqueles tempos - incluindo o nosso -, podemos notar uma pluralidade de abordagens que obedece a perspectivas distintas e, por vezes, conflitantes. Acrescenta-se a isso que, hoje em dia, temos herdado muitos atributos do trabalho das culturas anteriores, o que torna nossa sociedade representada, sociologicamente, por um caldeirão de comportamentos e conceitualizações relacionados ao trabalho, o que dificulta a partir de critérios mais ou menos consensuais. Posteriormente, veremos quais são esses critérios e como eles evoluíram ao longo da história para alicerçar nossa perspectiva contemporânea acerca do trabalho. -/- Hannah Arendt (1906-1975), dado às dificuldades supracitadas, decidiu traçar a etimologia dos termos de trabalho em questão, em sua famosa obra A condição humana de 2007, em que aclara os termos e as distinções entre trabalho e labor. Etimologicamente temos o grego distinguindo a partir de ponein e ergazesthai; o Latim entre laborare e facere ou fabricare; o inglês com labor e work e, por fim, o alemão entre arbeiten e werken. Em todos eles, aponta Arendt, apenas os equivalentes de “trabalho” significam, sem infortúnio, sofrimento e infelicidade. O Arbeiten alemão foi aplicado somente para designar as atividades de campo exercida pelos servos e não ao trabalho dos artesãos, denominado Werken. Outros autores sinalam que em francês Travailler que tem uma substituição do termo “trabalho”, vem do “Tripalium” (do latim “Tripaliare”, uma espécie de instrumento de tortura usado na antiguidade para castigar os escravos). De qualquer forma, todos os supra conceitos não são aceitos por todos os etimologistas. -/- Essas distinções são eloquentes na medida em que reproduzem a visão de diferentes e inúmeras culturas em relação ao trabalho. Nesse sentido, seguindo o pensamento arendtiano, existe um conceito que faz menção à uma avaliação notadamente negativa, e é o que deu origem à conformação do termo “labor”. Por outro lado, a mesma etimologia distingue outro termo (a obra) que representa conotações positivas. O que distingue os dois termos e o que popularizou Locke quando se referiu ao “trabalho de nossos corpos e trabalho de nossas mãos”? A diferença está, de acordo com Arendt, em que o trabalho cria bens fúteis dedicados ao mero consumo promovendo assim, com o passar dos anos, uma sociedade de massas onde desaparecerá o trabalho dito bem feito, típico de artesãos, que criam objetos de uso durável ao longo do tempo, mediante um processo de fabricação e que, em nenhum momento, implica o tédio ou a alienação características de uma sociedade de massa. Os gregos, segundo a pensadora, e então vamos confirmar isso, nunca praticaram essa diferença: tanto o trabalho quanto o artesanato na antiguidade grega eram reservados para os escravos, uma vez que todas as obrigações tinham uma natureza servil. Estes se opuseram à contemplação de quaisquer tipos de atividades. Nos chama a atenção que em nossa sociedade, a partir da idade moderna, houve a inversão da perspectiva acerca do trabalho, isto é, houve uma “glorificação” do mesmo em que foi conferido uma elevação do animal laborans sobre o animal racional. A pensadora alemã ainda nos diz que em vez da distinção trabalho-labor, surge outras que devemos nos atentar, são a relação entre trabalho produtivo e improdutivo; entre trabalho qualificado e não qualificado e, finalmente, entre o já conhecido binômio do trabalho manual-intelectual. A primeira dessas distinções, a relação entre produtividade e improdutividade, foi a mais transcendente e primordial nas origens das ciências econômica e social. Adam Smith (1723-1790) e Karl Marx desprezaram o trabalho improdutivo a tal ponto de não considerar o mesmo como trabalho ao menos que enriquecesse o mundo. Essa distinção se aproxima do supracitado trabalho-labor do princípio. A elevação do trabalho produtivo, acima das visões antigas; é expressamente perceptível em alguns autores clássicos. É o que acontece com as contribuições do filósofo Marx, para quem o trabalho é uma fonte de produtividade (originada na energia humana não exaurida e que produz a mais-valia); com Smith, para quem o trabalho é uma fonte de riqueza; e com Locke, para qual o trabalho é fonte de propriedade. -/- Em relação ao trabalho qualificado e não qualificado, Arendt nos diz que não tem mais sentido na atualidade a sua discussão, uma vez que, esse praticamente desapareceu sob a influência das modernas tecnologias organizacionais. Logo, a distinção entre trabalho e labor estaria obsoleta e abandonada em favor do próprio trabalho. -/- A distinção entre trabalho manual e intelectual tornou-se amplamente interessante desde a perspectiva arendtiana. Com efeito, como cada ocupação deve mostrar sua utilidade para toda a sociedade em seu conjunto, e a utilidade da ocupação intelectual -diz Arendt- chega a ser mais que duvidosa quando confrontada com a glorificação do trabalho, seria mais que natural que os intelectuais quisessem conformar a população laboriosa, algo inimaginável entre os gregos. A isso se soma a demanda que o mundo contemporâneo faz do trabalho intelectual. -/- O pensamento revolucionário do século XX não era alheio a essa distinção. Haya de la Torre (1895-1979), um pensador e líder da oposição peruana do século XX, disse afirmando claramente uma leitura de classe que divide o trabalhador do explorador: -/- “A revolução está em uma distinção que todos podemos fazer por si só: há aqueles que vivem do seu próprio trabalho e há aqueles que vivem do trabalho dos outros. Todos, de acordo com sua consciência, poderá decidir a qual dessas duas classes pertence” (1924, pp. 24-25). Kimberlé Crenshaw arrived at her famous phrase “intersectionality” by carefully thinking through speeches and writings given to us by early Black feminists, such as like Sojourner Truth and Anna J. Cooper. In this paper, I expand on this groundbreaking work in two somewhat surprising ways. First, I bring the ideas of these early Black feminists together with important, related proposals from W.E.B. Du Bois, Karl Marx, Hannah Arendt, and Simone de Beauvoir. Second, I relate these works to central ideas (...) in Kant’s practical philosophy in an effort to develop a Kantian theory of intersectionality. In addition to grasping the distinctive, destructive directions of oppressive forces aimed at women, the poor, and minorities, I seek to understand better the new, violently destructive elements found in European modernity, as evidenced both in European colonialization as well as the Holocaust. -/- This book is published under the OA CC-BY 4.0 license. In “Letter on Humanism,” Martin Heidegger juxtaposes the notion of homelessness (Heimlosigkeit) with home-coming (Heimholung), i.e. the reawakening to our original relationship to Being. This focus on dwelling in Being represents an interesting modification from his earlier study of “incipience” (Anfang), which emphasizes departure. We follow the critique of this shift in thinking in Hannah Arendt’s work, beginning with a short allegory titled “Heidegger the Fox” (1953). We suggest that reading this allegory in the light of Arendt’s decades-long debate (...) with Heidegger illuminates the tense relationship between dwelling and incipience (or in her terms, “natality”). Though we do not attempt a complete analysis of Heidegger and Arendt’s works here, we aim to draw out specific movements of their thinking. We suggest that Arendt’s concept of natality, which, though partly influenced by Heidegger, ultimately challenges the authenticity of Heidegger’s solitary, silent thinker who dwells in the House of Being. In the back and forth between their thinking an unresolvable tension between dwelling and departure arises as the existential fissure. (shrink)

The scholarship on Frantz Fanon’s theorization of violence is crowded with interpretations that follow the Arendtian paradigm of violence. These interpretations often discuss whether violence is instrumental or non-instrumental in Fanon’s work. This reading, I believe, is the result of approaching Fanon through Hannah Arendt’s framing of violence, i.e. through a binary paradigm of instrumental versus non-instrumental violence. Even some Fanon scholars who question Arendt’s reading of Fanon, do so by employing a similar binary logic, hence repeating the same (...) either/or paradigm of instrumental versus non-instrumental violence. I aim to challenge such interpretations of Fanon by demonstrating that in the context of anticolonial armed struggle in which Fanon writes, the either/or framework of the instrumental/non-instrumental binary of violence cannot fully capture his perspective. Violence can indeed be conceived as having both constructive and instrumental aspects. My argument is supported by Fanon’s corpus, including his 1960 Accra speech, “Why We Use Violence” in Alienation and Freedom. This piece, I suggest, together with Fanon’s other writings, poses a direct challenge to the Arendtian binary of violence. My analysis resists positioning the difference between Arendt and Fanon through the instrumental/non-instrumental binary. By using Judith Butler’s notion of “frame” I complicate their difference and argue Arendt’s framing of violence prevents her from apprehending Fanon and – more importantly – interpretations of Fanon based on this Arendtian frame of violence inevitably lead to misinterpretations. The IMF, World Bank, and former colonial powers have put pressure on African countries to adopt multiparty democracy. Because of this pressure, many formerly one‐party states as well as some military dictatorships have embraced Western and Parliamentarian democratic forms. But does this mean that democracy has succeeded in Africa? Ernest Wamba‐dia‐Wamba of the University of Dar‐es‐Saalam and CODESRIA argues that embracing Western paradigms in an unthinking fashion will not bring real democracy, i.e. people's liberation. He advances criticisms of party politics (...) and statism, and suggests that African palaver and people's movements are a surer site of political action. In his criticisms of representative government he parallels the thoughts and criticism of Hannah Arendt. Arendt advocated a council system that shares many of the attributes of African palaver communities. By consulting the criticisms of Arendt and Wamba‐dia‐Wamba, we can see that an easy optimism about the multiparty system is unfounded. (shrink)

Chapter 14. Andrea Timár engages with literary representations of the experience of perpetrators of dehumanization. Her chapter focuses on perpetrators of dehumanization who do not violate laws of their society (i.e., they are not criminals) but exemplify what Simona Forti, inspired by Hannah Arendt, calls “the normality of evil.” Through the parallel examples of Dezső Kosztolányi’s Anna Édes (1926) and Doris Lessing’s The Grass is Singing (1950), Timár first explores a possible clash between criminals and perpetrators of dehumanization, showing (...) literature’s exceptional ability to reveal the gap between ethics and law. Second, she examines novels focalized through perpetrators and the difficult narrative empathy they provoke, arguing that only the critical reading of these novels can make one engage with the potential perpetrator in oneself. As case studies, Timár examines Daniel Defoe’s Robinson Crusoe (1719), which may potentially turn its reader into an accomplice in the process of dehumanization, and J.M. Coetzee’s Foe (1986), which puts on critical display the dehumanizing potentials of both aesthetic representation and sympathy as imaginative violence. Third, she reads Jonathan Littell’s The Kindly Ones [Les Bienveillantes, 2006], which can make the reader question, through the polyphony of the voice of its protagonist, the notions of narrative voice and readerly empathy, only to reveal that the difficulty involved in empathizing with perpetrator characters lies not so much in the characters’ being perpetrators, but rather in their being literary characters. Eventually, Timár briefly touches upon the problem of the aesthetic and the comic via Nabokov’s Lolita (1955) to ask whether one can avoid some necessarily dehumanizing aspects of humor. (shrink)

A complimentary assessment of Blum's award-winning book about racism and its affects. Well written as it is, it needs to be supplemented with a definition of racial injustice, and also to analyze racism not only on the level of individual morality but from a human rights perspective that discredits political and economic motives for racism (e.g., by drawing on Hannah Arendt's Origins of Totalitarianism).

ALL THE MORE, by Avi Sion, Ph.D., comprises a merged list of 72 qal vachomer arguments in the Tanakh, i.e. of a fortiori arguments in the Hebrew Bible. This listing brings together lists proposed in past rabbinic literature and in more recent studies by the author. The literature research for it was carried out mainly by R. Yaakov Gabay, who looked into works in Hebrew by five rabbis who had proposed lists, namely: R. Shmuel Yaffe Ashkenazi (Yefeh Toar, 1597), R. (...) Zvi Hirsch Katzenellenbogen (Netivot Olam, 1822), R. Zeev Wolf Einhorn (Midrash Tannaim, 1839), R. Mattityahu Strashun (Mattat Yah, 1892), R. Chaim Hirschensohn (Berure HaMidot, 1928). The author of the present essay brought additional information from the Tanakh commentary of R. Shlomo Yitzchaki (Rashi, 11th Cent.) and an essay by R. Louis Jacobs (2005), as well as from his own past works (Judaic Logic, 1995, and A Fortiori Logic, 2013). The information thus gathered is here presented in a systematic manner, after careful evaluation by the author of each case with reference to narrative context, language used, and logical form. Efforts are made to identify which cases were known to each of the past authors, and to determine who found each case first and whether subsequent listings of the case (if any) were independent or derivative. Both G.F.W. Hegel and Carl Schmitt took seriously the problem of political sovereignty entailed by liberal political theories. In Dictatorship (1919) and Political Theology (1922), Schmitt rejects liberal political theories that argue for the immediate unity of democracy and legality i.e., popular sovereignty, because he thinks they cannot secure political sovereignty. In the Philosophy of Right, Hegel denounces popular sovereignty for similar reasons. Yet given Schmitt’s negative assessment of Hegel their positions are seldom related to one another. I argue in (...) this paper that Schmitt’s analysis of liberal political theories is similar to Hegel’s analysis of Rousseau’s liberal ideas. I contend, however, that Schmitt’s solution, which collapses the distinction between the executive and the legislative power in favor of the former, fails to secure political sovereignty. Contrary to Schmitt, Hegel conceives of the liberal predicament as a basic determination of any political state that rests on the division of the legislative and executive power. Hegel argues that the constitutional monarchy is a genuine instantiation of political sovereignty that can maintain not only the division of these powers, but also their unity. In this regard, I argue that Hegel’s conception of the division of powers provides a more convincing theory of the problem afflicting modern states than Schmitt’s and at least deserves to be taken more seriously by critics of Schmitt’s solution such as Hannah Arendt, Leo Strauss, Jurgen Habermas, Andreas Kalyvas and Chantal Mouffe. TWENTIETH-CENTURY ETHICS. AFTER NIETZSCHE -/- Preface This book tells the story of twentieth-century ethics or, in more detail, it reconstructs the history of a discussion on the foundations of ethics which had a start with Nietzsche and Sidgwick, the leading proponents of late-nineteenth-century moral scepticism. During the first half of the century, the prevailing trends tended to exclude the possibility of normative ethics. On the Continent, the trend was to transform ethics into a philosophy of existence whose self-appointed task was (...) that of describing the human condition as consisting of choices, as unavoidable as arbitrary, without any attempt at providing criteria for making such choices. In the Anglo-Saxon countries, the heir of ethics was a philosophy of morality, that is, an analysis of the language of morality that intended to clarify valuations without trying to justify them. 1958 was the year of the normative turn that led to the Rehabilitation of practical philosophy, a turn followed by decades of controversies between distinct kinds of normative ethics: utilitarian, Kantian, virtue ethics. While the controversy was raging, a quiet revolution took place, that of applied ethics which surprisingly dissolved the controversy's very subject matter by providing methods for making convergence possible on intermediate principles even when no agreement was available about first principles. The normative turn and the revolution of applied ethics have led us, at the turn of the century, to a goal that was quite far from the starting point. Alfred Julius Ayer is indicated as a typical proponent of such non-cognitivist meta-ethics. More detailed discussion is dedicated to Bertrand Russell's ethics, a more nuanced and sophisticated doctrine, arguing that non-cognitivism does not condemn morality to arbitrariness and that the project of rational normative ethics is still possible, heading finally to the justification of a kind of non-hedonist utilitarianism. Stevenson's theory, another moderate version of emotivism is discussed at some length, showing how the author comes close to the discovery of the role of a pragmatic dimension of language as a basis for ethical argument. A final section discusses Nicolai Hartman, who always refused to define himself a phenomenologist and yet developed a more articulated and detailed theory of 'values' – with surprising affinities with George E. It argues that: a) her answer to the question "why should I be moral?" requires a solution of the problem of theodicy, and ignores any attempts to save the moral point of view without recourse to divine retribution; b) her notion of divine law is an odd one more neo-Augustinian than Biblical or Scholastic; c) her image of Kantian ethics and intuitionism is the impoverished image manufactured by consequentialist opponents for polemical purposes and that she seems strangely accept it; d) the difficulty of identifying the "relevant descriptions" of acts is not an argument in favour of an ethics of virtue and against consequentialism or Kantian ethics, and indeed the role of judgment in the latter is a response to the difficulties raised by the case of judgment concerning future action. The chapter gives a short look at further developments in the neo-naturalist current trough a reconstruction of Philippa Foot's and Peter Geach's critiques to the naturalist-fallacy argument and Alasdair MacIntyre's grand reconstruction of the origins and allegedly inevitable failure of the Enlightenment project of an autonomous ethic. -/- ● X Normative ethics: Kantian and rights-based ethics 1.
